If you do not agree with any part of these Terms, please do not use our website. These Terms govern your use of our website and any services, information, promotions, or content provided through it.

Services Information

The information provided on this website, including descriptions of services, pricing, and promotions, is for general informational purposes only. While we make every effort to keep information accurate and up to date, actual services, availability, and pricing may vary and are subject to change without notice. Final details, scope of work, and pricing will always be confirmed in writing following an in-person consultation and estimate.

Quotes & Estimates

Any quotes or estimates provided through this website, by phone, or by email are for informational purposes only and are not binding. Final pricing and scope of work will be determined only after an in-person inspection of the project site has been conducted. A written estimate is required to confirm any project details, pricing, or scheduling. Additional work requested or required outside the original estimate may result in revised pricing.

Project Terms

All projects will be performed according to the written agreement between Midnight Coatings LLC. and the client. The scope of work, including materials, coatings, finishes, and preparation methods, will be outlined in the agreement. Variations in color, texture, and finish may occur due to natural concrete conditions, lighting, and material characteristics, and such variations do not constitute a defect. Surface preparation may reveal pre-existing cracks, stains, or imperfections in the concrete, which may not be fully correctable. Unless otherwise specified in writing, Midnight Coatings does not guarantee the elimination of such imperfections. Any warranty details, if applicable, will be provided in the written agreement for the specific project.

Payment Terms

A deposit is required to secure scheduling for all projects. Progress payments may be required for larger projects, as specified in the written agreement. The balance of payment is due upon completion of the project, unless otherwise agreed in writing. Midnight Coatings LLC. accepts payment by cash, check, credit, debit, or other approved electronic methods. Late payments may be subject to additional fees, interest charges, or collection costs as permitted by law. The client is responsible for all costs associated with collecting overdue payments.

Deposit Terms

To reserve an installation date, Midnight Coatings LLC requires a project deposit. This deposit secures the client’s place on the production schedule and allows materials and resources to be allocated accordingly.

Refunds & Cancellations

  • Deposits are 100% refundable if the project is cancelled more than three (3) calendar days before the scheduled installation date.

  • Cancellations made within three (3) calendar days of the scheduled installation may be subject to a material restocking fee of fifteen percent (15%) of the total contract amount, which will be deducted from the refund.

  • Refunds will be processed within a reasonable period following written notice of cancellation.

Rescheduling

  • Clients may reschedule their installation date without penalty, provided reasonable notice is given.

  • Midnight Coatings LLC reserves the right to limit excessive rescheduling. If a client initiates three (3) or more reschedules, Midnight Coatings LLC may, at its discretion, cancel the project and issue a refund of the deposit, less any applicable costs or restocking fees.

Company-Initiated Cancellations

  • Midnight Coatings LLC reserves the right to postpone, reschedule, or cancel a project due to unforeseen circumstances, such as weather conditions, material delays, or other operational factors. In such cases, the client’s deposit will remain fully refundable or transferable to a new installation date.

Promotional Terms

From time to time, Midnight Coatings LLC. may advertise promotional offers. All promotions are subject to the following conditions unless otherwise stated in writing:

  • Promotions are subject to change or withdrawal at any time without notice.

  • Promotions cannot be combined with other discounts or offers unless expressly stated.

  • A minimum service charge of $899 applies to all projects, regardless of size or scope.

2-Car Garage Promotion

  • The advertised price of “2-Car Garage Starting at $899” is based on a standard 2-car garage size of approximately 400 sq. ft. at $2.25 per sq. ft.

  • This promotion applies exclusively to single solid color epoxy coatings.

  • Additional services such as surface repair, moisture barriers, decorative flakes, custom finishes, or topcoats are not included in the promotional price and may result in additional charges.

  • Final pricing is subject to an in-person inspection and a written estimate.

“New Garage Floor in 3 Days” Promotion

  • The “3-Day Garage Floor” promotion reflects a target project timeline and is not a guarantee.

  • The timeline begins after the in-person estimate and depends on conditions such as weather, concrete condition, repairs needed, material availability, and client scheduling.

  • While Midnight Coatings strives to complete projects within three days, actual project duration may vary.

Disclaimer of Guarantees

Promotional claims such as “starting at $899” or “in 3 days” are intended as goals and examples, not guarantees. Actual project costs and timelines depend on individual project conditions. Midnight Coatings LLC. reserves the right to adjust pricing, scheduling, and services as necessary.

Disclaimer of Lifetime Warranty

Midnight Coatings LLC offers a Limited Lifetime Warranty on the workmanship and installation craftsmanship of our flooring systems. This warranty specifically covers proper installation techniques that ensure adhesion of the coating to the prepared surface for as long as the original customer owns the property.

Scope of Warranty

  • This warranty applies only to the craftsmanship of the installation.
  • It guarantees that the epoxy or coating system will properly bond to the prepared concrete surface if applied in accordance with industry standards and our installation process.
  • This warranty does not extend to the inherent life expectancy of the product itself.

 

Manufacturer’s Warranty

  • All materials and coating products are subject solely to the manufacturer’s warranty, which defines the expected lifespan and coverage of the product.
  • Midnight Coatings LLC does not warrant the product beyond the scope of the manufacturer’s stated coverage.

 

Exclusions & Limitations

This warranty does not cover, and Midnight Coatings LLC shall not be responsible for, the following:

  • Normal wear and tear, including fading, scratching, surface dulling, or loss of gloss over time.
  • Cracks, shifting, or movement of the underlying concrete slab.
  • Moisture-related issues, including hydrostatic pressure, vapor emissions, or water intrusion.
  • Damage caused by misuse, neglect, improper cleaning methods, chemical spills, or exposure to conditions outside the product’s specifications.
  • Failure to maintain the flooring system, including neglecting recommended restoration or resealing over time.
  • Any alterations, repairs, or modifications made by third parties after installation.

 

Restoration Notice

All flooring systems, including epoxy and specialty coatings, require maintenance or restoration at some point during their service life. This warranty does not guarantee that the flooring will remain in its original condition indefinitely, but rather ensures that the original installation craftsmanship remains sound.

Limitation of Liability

In the event of a valid warranty claim, Midnight Coatings LLC’s sole obligation shall be limited to the repair or reinstallation of the affected area, at our discretion. Under no circumstances shall Midnight Coatings LLC be liable for incidental, consequential, or secondary damages, including but not limited to loss of use, inconvenience, or damage to personal property.

Liability Limitations

Midnight Coatings LLC. is not liable for damages beyond the scope of work performed as outlined in the written agreement. We are not responsible for issues resulting from pre-existing conditions of the concrete slab, such as cracks, moisture intrusion, or structural defects. We are not responsible for damages caused by third-party contractors, external factors such as weather, or misuse of the installed flooring after completion. To the fullest extent permitted by law, our liability shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
